Welcome to Mkulima Connect ("Platform," "we," "us," or "our"), a digital marketplace connecting farmers, buyers, agro-dealers, and agricultural service providers across Kenya. These Terms and Conditions ("Terms") govern your access and use of our website, mobile application, and related services.

By registering an account, browsing, or transacting on Mkulima Connect, you agree to comply with these Terms, our Privacy Policy, and any additional guidelines. If you disagree, please refrain from using the Platform.

2. Eligibility & Account Registration

2.1 User Eligibility

  • You must be at least 18 years old and legally capable of entering binding contracts.

  • Businesses must be duly registered under Kenyan law.

2.2 Account Creation

  • Provide accurate, current, and complete information (name, contact, business details).

  • Maintain confidentiality of login credentials – you are responsible for all account activities.

  • Notify us immediately of unauthorized access or security breaches.

2.3 Account Suspension/Termination

We reserve the right to suspend or terminate accounts that:

  • Provide false information.

  • Engage in fraudulent, illegal, or unethical practices.

  • Violate these Terms.

3. Platform Usage & Responsibilities

3.1 For Farmers & Sellers

  • Product Listings: Ensure accurate descriptions (quantity, quality, pricing, images).

  • Pricing & Availability: Update stock availability promptly; no hidden charges.

  • Transaction Fulfillment: Honor agreed delivery/pickup terms with buyers.

3.2 For Buyers & Agri-Service Seekers

  • Due Diligence: Verify product/service details before purchasing.

  • Payment Compliance: Adhere to agreed payment terms (escrow, mobile money, bank transfer).

  • Dispute Reporting: Raise issues within 48 hours of delivery/service completion.

3.3 Prohibited Activities

You must NOT:
✔ Sell counterfeit, expired, or prohibited items (e.g., banned agrochemicals).
✔ Misrepresent products/services or engage in price manipulation.
✔ Spam users, spread malware, or disrupt Platform operations.

4. Transactions & Financial Terms

4.1 Pricing & Fees

  • Sellers set prices; Mkulima Connect may charge service fees for premium features.

  • All prices must be in Kenyan Shillings (KES) unless otherwise agreed.

4.2 Payment Methods

  • Mobile Money (M-Pesa, Airtel Money)

  • Bank Transfers

  • Escrow Services (for high-value transactions)

4.3 Refunds & Disputes

  • Buyers may request refunds if products/services are not as described.

  • Mkulima Connect may mediate but is not liable for third-party disputes.

5. Intellectual Property Rights

  • All Platform content (logos, text, software) is owned by Mkulima Connect or licensors.

  • Users grant us a license to display their product listings and transaction data.

6. Limitation of Liability

  • We do not guarantee uninterrupted, error-free service.

  • We are not liable for:

    • Losses from transactions between users.

    • Delays/cancellations due to internet outages, natural disasters, or legal restrictions.

7. Termination & Amendments

  • We may update these Terms periodically; continued use constitutes acceptance.

  • Users may terminate accounts via written notice.

8. Governing Law & Dispute Resolution

  • These Terms are governed by Kenyan law.

  • Disputes shall first undergo mediation; unresolved matters escalate to courts.
